1. Agreement to Terms

By accessing or using Color Keeps ("the Service") at colorkeeps.com, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

Color Keeps is an AI-powered platform that transforms family photos and descriptions into personalized coloring books. Our Service includes:

• AI-generated coloring page creation from photos or text descriptions
• Digital PDF downloads of coloring books
• Professional print fulfillment services
• Credit-based usage system

3. Account Registration

To use our Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

You must be at least 18 years old to create an account. While the coloring books are designed for children, account holders must be adults.

4. Credits and Payments

4.1 Credit System

Our Service uses a credit-based system. Credits are required to generate coloring pages and access premium features. New accounts receive 2 free credits.

4.2 Credit Purchases

Credit purchases are processed through Stripe. All purchases are final except as described in our Refund Policy.

4.3 Credit Expiration

Credits do not expire as long as your account remains active. Unused credits are forfeited upon account deletion.

5. Acceptable Use

You agree NOT to use the Service to:

• Upload content that is illegal, harmful, or violates others' rights
• Upload photos of individuals without their consent or legal authority
• Create content that is sexually explicit, violent, or inappropriate for children
• Attempt to circumvent our AI safety measures or content filters
• Use automated systems or bots to access the Service
• Reverse engineer or attempt to extract our AI models or algorithms
• Resell or redistribute generated content for commercial purposes
• Violate any applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate these guidelines.

6. Content Ownership

6.1 Your Content

You retain all rights to the photos and content you upload. By uploading content, you grant us a limited license to process it for the purpose of providing the Service.

6.2 Generated Content

Coloring pages generated through our Service are owned by you for personal use. You may print, share, and use them for personal, non-commercial purposes. Commercial use requires our written permission.

6.3 Our Content

The Service, including its design, features, and underlying technology, is owned by Color Keeps and protected by intellectual property laws.

7. Print Orders

Physical print orders are fulfilled by our partner Printful. By placing a print order:

• You acknowledge that production and shipping times may vary
• You agree to provide accurate shipping information
• You understand that print quality depends on the source image quality
• You accept Printful's terms of service for print fulfillment

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability or fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation
• Accuracy of AI-generated content

AI-generated content may not always meet your expectations. We provide regeneration options and customer support to help you achieve satisfactory results.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLOR KEEPS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

10. Indemnification

You agree to indemnify and hold harmless Color Keeps and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of significant changes when possible. Continued use of the Service after changes constitutes acceptance of the modifications.

12. Termination

We may terminate or suspend your account at our discretion for violations of these Terms or for any other reason. You may delete your account at any time through your account settings.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (e.g., ownership, indemnification, limitation of liability) will survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in San Francisco, California.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
